    Suggested 26 US Constitution Amendments (Part 2 of 8): Legislative Branch

    This PurpleSlog series will suggest 26 amendments, (plus 2 “stretch” amendments). Additionally I will note 9 common amendment ideas that I think should be passed on.

    Confirmation Process Time Constraint Amendment

    What

    Place a limit of 120 days on the time for the Senate to hold a vote for a presidential nominee, after which the nominee is automatically confirmed. No filibustering is allowed on the vote.

    Why

    There are too many delay in the presidential appointment / confirmation process that reduce efficiency and effectiveness of executive branch. This is a control on the abuse of power.

    Basic Rules for the Operation of Congress Amendment

    What

    Mandatory basic rules of order, procedure, organization and conduct for Congress including: limitation of legislation to one subject; abolishing filibuster, rules for closure, rules for discharging bills should minimize authority of party leaders, maximize chance for debate and voting; prevent irrelevant riders to appropriation bills, 2-year budgeting, choice and instant runoff voting when possible; IRV for Speaker of the House; IRV for senate president pro-temp position; sunset clauses (for new programs, and executive bodies, advisory bodies); no secret conference committee proceedings; all congressmen can bring 2 bills for floor votes per session bypassing committees, remove senatorial hold privilege, prevent congress from funding religious or partisan activities for itself.

    Why

    We know from Public Choice Theory that representatives respond to incentives and are therefore not driven to serve the public good, but instead to maximize there own benefits The system as developed over time does not server the nation well. Left to there own devices, congress will continue negative practices. This amendment is an operational control to increase congressional accountability

    Spending Control Amendment

    What

    1. Requiring a Super-Majority of (three-fifths (60%) for both houses for spending above 90% of previous year.
    2. Majority vote only required for spending to continue at 90% of previous year level or below.
    3. Defining spending as all net payments moving from the treasury to other hands
    4. If congress fails to pass a budget, the Executive will reduce spending to 90% level, equally across the board.

    Why

    We know from Public Choice Theory that representatives respond to incentives and are therefore not driven to server the public good, but instead to maximize there own benefits. Rent-seeking by special interest has caused spending to go out of control. The system as developed over time does not server the nation well. Left to there own devices, congress will continue negative practices. This amendment is a financial control.

    Spending and Taxing Consideration Amendment

    What

    Require all that Legislation, involving spending or taxing to be considered by both houses for at least four days before it passage (or else be invalid).

    Why

    This will deter special interests from inserting special provisions in the dead of night (public choice).

    Modern Warfighting Power Amendment

    What

    Constitutional Amendment to update federal declarative war powers for the 21st century and for 3rd/4th/5th Generation War – details TBD in a Future PurpleSlog post.

    Why

    Update congressional oversight for modern warfare
