I am okay with executing Child Rapists

Atlas Shrugs notes:

In a 5-4 vote, the court said the Louisiana law allowing the death penalty to be imposed in such cases violates the Constitution’s ban on cruel and unusual punishment.

“The death penalty is not a proportional punishment for the rape of a child,” Justice Anthony Kennedy wrote in his majority opinion.

Let me be on the record so there is no doubt: I am okay with executing Child Rapist. I am also okay with roughing them up.

Since the Supreme Court has ruled that it is not ok, congress should start the process of amending the US Constitution to allow (but not require) states to choose to enact laws for the execution of Child Rapist.

I think this is #37.

  1. The term is vague, “child rapist.” I’m assuming your referring to forced rape and not statutory rape?

    I mean if somebody aged 24 has concensual sex with somebody 17 I think the death penalty is a bit harsh.

  2. You are correct that I do not mean consensual sex (statutory rape) with a 17 year old.

    Note that sex with somebody who is pre-puberty cannot be consensual.

  3. I see a silver lining. The author of the majority decision (stevens or kennedy, sorry memory fails) stated as 1 of his 2 main points that it was a rare practice, only being legal in fewer than 8 states and very few executions since the 60’s.
    If more states pass laws authorizing the execution of 12 and under child rapists and more of these rapists are put on death row, I see this decision being overturned in 2-4 years.

    My issue with the death penalty (for murder, child rape or any rape for that matter) has nothing to do with the morality or cruelness off it. Rather it’s the fallibility of our own systems. Every year we hear about some poor bastard getting exonerated after a decade on death row or in jail.

    I understand that. I am okay with being careful and taking 10+ years before execution.

    I was against the death penalty until the early 1990’s. Wisconsin hasn’t had the death penalty since pretty much the first person executed in the 1850’s turned out to be innocent.

    I became pro-death penalty when a mom stopped for fast-food chicken with her kids (at a place I drove by leaving work) and was executed as an after thought at at a robbery.

    The robber declared she wasn’t showing them enough respect. They made her get down on her knees. In front of her kids they put a shotgun to her head. They blew her head off.

    Those involved should have been executed. Since then I have felt that there are certain crimes where I just want the perpetrators to be executed no matter how long it takes.

    Child rapists don’t deserve the mercy of a state execution, they deserve Life in Prison without parole and special protections; so the other inmates will have many chances to gang-rape and then torture the vermin to death when they are sick of him.

  8. This has got to be the easiest way of paralyzing good government and inciting the public to revolution via lawlessness and chaos.

    What’s the major reason Sunnis gave for why they backed Al Qaeda against the US? Apart from foreign occupation, it was insecurity. They weren’t secure cause they don’t know how to make deals with Americans that can’t be bribed. Now that’s insecurity for you when you have survived up to now by bribing and being bribed by Saddam and Co.

    Who’s going to guarantee that sometime in the future, the law won’t change or that President or Governor won’t get into power and pardon them? Will you be the one that personally executes them if there is a chance that they will be released legally? If not, then you got nothing on this debate except false promises.

    The absolutely most disgusting evidence of sentient life is the individual and organism that will feel high and mighty because they have gotten lower forms of life to do their dirty work. These are also known as Democrats and fake liberals, but that’s not all of em.

    Life is a thing of risks. You can make a choice now and take the consequences now, or you can wait and hope technology produces a 100% verifiable truth detector. The people that were on death row had enough time for DNA and new evidence to surface. All of which is available now, to the criminals in jail.

    If one is to refrain from sentencing guilt, the only real alternative, as oppose to releasing them, is life in prison and that’s no more fair than the death penalty.

  10. I can see doing a Constitutional amendment laying out the general circumstances under which the death penalty can or cannot be administered. That’s a basic rights issue. I cannot see an amendment addressing its use as punishment for specific crimes–that opens up the door for amendments on other punishments and other crimes.

    Sounds nitpicky, yes, but I’m from Colorado. As I type this, a ballot initiative approaches in the voters will be asked to approve or deny an amendment to the COLORADO CONSTITUTION on whether Bingo parlors shall be regulated by the gaming commission or the State Dept. I shit you not. Maybe my exact feel for what does or does not belong in a constitution is off, but I have reasons for taking it seriously and for thinking that a basic constitutional issue is being overlooked here.

  11. Michael, I understand your POV.Getting as specific as you suggests would be overkill.

    Maybe the admendment can be as simple as just suggesting the crimes that can be considered capital (have a death penalty) and under what circumstance (witness/evidence scope).

    -Murder
    -Child Rape
    -Treason
    -Terrorism against the USA/US/Citizen/Legal Resident
    -Attempted Terrorism against the USA/US Citizen/Legal Resident
    -Material Support of Terrorism against the USA/US Citizen/Legal Resident

    …and maybe…
    -Rape
    -Mega Theft ( $1million +)
